Abstract

Makalemizde, Hanefî fıkhının ilk derleyicisi olarak kabul edilen İmam Muhammed’den başlayarak klasik anlamda son fakih olan İbn Âbidîn’e kadar Hanefi fukahasının kaleme almış oldukları irili ufaklı yüzlerce fürû’ metni arasında mezhebin temel çizgisini aksettiren eserler üzerinden, ceza hukukunda ta’zîr konusunu inceledik. Hanefî fıkıh tarihini üç ana döneme ayırarak bu dönemlerde yazılmış kitaplarda ta’zîr konusunun nasıl ele alındığını, nasıl bir gelişim gösterdiğini, kitapların birbiriyle ilişkilerini ve birbirine etkilerini görmeye çalıştık.
